Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Cumulant Public Safety Portal and any related websites, pages, applications, or services that link to these Terms (collectively, the "Portal").
The Portal is operated by Cumulant AI, Inc. ("Cumulant," "we," "us," or "our").
By accessing or using the Portal, you agree to these Terms. If you do not agree to these Terms, do not use the Portal.
1. Description of the Portal
Cumulant builds tools that help communities, public agencies, and decision makers understand street safety using real-world roadway evidence.
The Portal may display public-facing study pages, site summaries, maps, video clips, images, findings, statistics, and other materials related to roadway safety studies.
The Portal is intended to help users understand observed street-safety conditions, roadway interactions, and location-specific safety issues.
2. Informational Use Only
The Portal is provided for informational, educational, planning, research, and civic decision-support purposes.
Portal content may include observations, evidence clips, summaries, findings, or statistics generated from limited deployments, selected study periods, or specific camera views. Portal content may not reflect all activity at a location, all relevant safety issues, or all conditions over time.
Cumulant does not guarantee that Portal content is complete, current, error-free, or suitable for any specific purpose.
3. No Emergency, Enforcement, or Official Determination Use
The Portal is not an emergency reporting tool. Do not use the Portal to report emergencies, crimes in progress, roadway hazards requiring immediate response, or other urgent situations. In an emergency, call 911 or the appropriate emergency service.
Unless expressly stated in writing by an authorized public agency, Portal content is not an official government determination, traffic engineering determination, legal conclusion, citation, enforcement record, or finding of fault.
Cumulant does not use the Portal to identify, accuse, cite, penalize, or enforce laws against private individuals.
4. Public Evidence and Safety Findings
The Portal may include reviewed video clips, images, maps, notes, summaries, or other materials from public street environments. These materials are intended to support roadway safety findings and public understanding of observed conditions.
Street-observation media may incidentally include people, vehicles, buildings, homes, license plates, or other activity visible from public streets or public rights-of-way.
You may not use Portal content to identify, track, shame, harass, threaten, target, or otherwise harm private individuals.
Cumulant may edit, remove, restrict, replace, update, or decline to publish any Portal content at any time, including evidence clips, images, findings, statistics, or site summaries.
5. Privacy and Public Evidence Review Requests
Your use of the Portal is also governed by our Privacy Policy.
If you believe Portal content includes private, identifying, sensitive, inaccurate, or inappropriate information, contact us at [email protected].
Please include:
- The page URL
- A brief description of the concern
- The approximate clip, image, map, finding, or section involved
- Any other information that helps us locate the issue
Cumulant may review, remove, restrict, correct, or update content at its discretion.
6. Accounts and Authorized Access
Most public users do not need to sign in to view public Portal pages.
Some features may require sign-in, including administrative, editing, publishing, review, or restricted-access functions. If you create or use an account, you are responsible for maintaining the confidentiality of your login credentials and for activity under your account.
You may not access or attempt to access any administrative, private, unpublished, restricted, or non-public area of the Portal unless you are authorized to do so.
You must notify Cumulant promptly if you believe your account or access credentials have been compromised.
7. Acceptable Use
You agree not to:
- Use the Portal for any unlawful, harmful, fraudulent, abusive, or unauthorized purpose
- Attempt to gain unauthorized access to the Portal, accounts, systems, databases, storage buckets, APIs, or infrastructure
- Interfere with or disrupt the Portal or its security features
- Scrape, copy, harvest, bulk-download, or extract Portal content in a way that exceeds ordinary public viewing
- Use Portal content to identify, track, harass, shame, threaten, or target private individuals
- Misrepresent Portal findings as official citations, enforcement records, legal conclusions, or guarantees of safety
- Remove, alter, or obscure copyright, trademark, attribution, or proprietary notices
- Reverse engineer, decompile, or attempt to derive source code from the Portal except where allowed by law
- Upload, submit, transmit, or attempt to introduce malware, malicious code, spam, or abusive content
- Use automated tools to access the Portal in a way that burdens, disrupts, or degrades the service
- Use the Portal or Portal content to train, validate, or operate surveillance, identification, enforcement, or profiling systems without Cumulant's written permission
Cumulant may suspend, restrict, or terminate access for users who violate these Terms or create risk for the Portal, Cumulant, public partners, or other users.
8. User Submissions
The current public Portal does not collect public resident-submitted reports, photos, free-text incident reports, or public evidence uploads.
If Cumulant later enables public submissions, reporting features, newsletter sign-ups, feedback tools, or similar features, additional terms or disclosures may apply.
If you choose to submit information to Cumulant, you represent that you have the right to provide that information and that your submission does not violate law, infringe another person's rights, or include unlawful, defamatory, threatening, invasive, or abusive material.
Unless otherwise stated, you grant Cumulant a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, display, publish, analyze, and process your submission for purposes related to operating the Portal, conducting roadway safety studies, responding to your request, improving our services, and communicating with public partners or project stakeholders.
Cumulant may decline to publish, edit, remove, or restrict any submission at its discretion.
9. Cumulant Content and Intellectual Property
The Portal, including its software, design, text, graphics, maps, layouts, study summaries, findings, visualizations, trademarks, logos, and other materials, is owned by Cumulant or its licensors, unless otherwise indicated.
These Terms do not grant you ownership of the Portal or any Cumulant intellectual property.
You may view publicly available Portal content for personal, civic, educational, planning, or public-interest purposes, subject to these Terms.
You may not copy, reproduce, distribute, modify, sell, sublicense, or commercially exploit Portal content without Cumulant's written permission, except as allowed by law.
10. Public Agency and Third-Party Materials
Some Portal content may relate to work performed with or for public agencies, study sponsors, community organizations, or other project partners.
Unless expressly stated, references to a city, agency, location, project, or partner do not mean that the referenced party has endorsed Cumulant, approved all Portal content, or adopted Cumulant's findings as official policy.
The Portal may include links to third-party websites or services. Cumulant does not control and is not responsible for third-party websites, services, content, privacy practices, or terms.
11. Third-Party Services and Infrastructure
Cumulant may rely on third-party providers for hosting, storage, authentication, databases, email delivery, error monitoring, logging, security, maps, and other operational services.
Your use of certain Portal features may also be subject to third-party terms, such as authentication provider terms or map provider terms.
Cumulant is not responsible for interruptions, errors, or security events caused by third-party services outside Cumulant's reasonable control.
12. Changes to the Portal
Cumulant may update, modify, suspend, restrict, or discontinue any part of the Portal at any time.
Cumulant may also update, correct, remove, or replace Portal content, including study pages, findings, evidence clips, maps, statistics, and summaries.
We do not guarantee that any Portal content will remain available indefinitely.
13. Disclaimers
The Portal and all Portal content are provided "as is" and "as available."
To the maximum extent permitted by law, Cumulant disclaims all warranties, express or implied, including warranties of accuracy, completeness, reliability, merchantability, fitness for a particular purpose, non-infringement, availability, and security.
Cumulant does not warrant that:
- The Portal will be uninterrupted, secure, or error-free
- Portal content will be complete, current, or accurate
- Safety findings will capture all relevant roadway risks
- Evidence clips will represent all activity at a location
- The Portal will meet your needs or expectations
- Any particular roadway, route, intersection, or public space is safe or unsafe
You are responsible for evaluating Portal content and using appropriate judgment before relying on it.
14. Limitation of Liability
To the maximum extent permitted by law, Cumulant and its officers, directors, employees, contractors, agents, affiliates, suppliers, and partners will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, business interruption, reputational harm, or other losses arising from or related to your use of or inability to use the Portal.
To the maximum extent permitted by law, Cumulant's total liability for claims arising from or related to the Portal or these Terms will not exceed one hundred dollars ($100) or the amount you paid Cumulant to use the Portal in the twelve months before the claim, whichever is greater.
Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.
15. Indemnification
You agree to defend, indemnify, and hold harmless Cumulant and its officers, directors, employees, contractors, agents, affiliates, suppliers, and partners from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising from or related to:
- Your use or misuse of the Portal
- Your violation of these Terms
- Your violation of law or another person's rights
- Your submissions, if any
- Your unauthorized use, copying, distribution, or exploitation of Portal content
- Your use of Portal content to identify, track, harass, shame, threaten, or target any person
Cumulant may assume exclusive control of the defense of any matter subject to indemnification, and you agree to cooperate with Cumulant's defense.
16. Termination or Restriction of Access
Cumulant may suspend, restrict, or terminate your access to the Portal at any time if we believe you have violated these Terms, created risk, attempted unauthorized access, misused Portal content, or otherwise acted in a way that may harm Cumulant, the Portal, public partners, or other users.
You may stop using the Portal at any time.
Sections that by their nature should survive termination will survive, including sections related to intellectual property, disclaimers, limitation of liability, indemnification, governing law, and dispute resolution.
17. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
You agree that any dispute arising from or related to these Terms or the Portal will be brought in the state or federal courts located in California, unless applicable law requires otherwise.
18. Changes to These Terms
Cumulant may update these Terms from time to time. If we make material changes, we will update the effective date above and post the revised Terms on this page.
Continued use of the Portal after updated Terms are posted means you accept the updated Terms.
